TERMS AND CONDITIONS UNDER WHICH PASSAGE TICKET IS ISSUED

The solicitation, issuance, and consequent acceptance of this ticket by the Passenger shall be deemed as an act of
acceptance of the following conditions, including those instructions printed on the reverse side of the Embarkation Stub.

1. TICKET VALIDITY. This ticket is valid only for passage on the sailing date and vessel stated herein. Ticket holder must be on board the vessel two (2) hours before departure time.
2. NON-TRANSFERABILITY. This ticket is NON-TRANSFERABLE and shall be used solely by the passenger designated
herein. A transfer may be permitted only upon the authorization, in writing, by the head office or by the issuing branch
or agency.
3. COMPLIANCE OF RULES AND REGULATIONS. Passenger undertakes to faithfully comply with the rules & regulations of the Carrier particularly those regarding maintenance of peace and order, safety, and sanitation on board the vessel.
4. LIMITED LIABILITY. Passenger assumes the risk and agrees that Carrier shall not be liable for any injury, death, or delay of passenger's baggage, effects, or properties, arising from, caused by, or in the judgment of the Carrier or master, rendered necessary or advisable by reason of any and all forms of fortuitous event or force majeure, which are beyond the control of the Carrier, its agents or employees.

It is hereby agreed that baggage means and includes only such property as reasonably required for the personal use and convenience of passenger with respect to the voyage, excluding all money, jewelry, merchandise, securities, and other articles of a similar nature.

Unless transported under the Carrier's bill of lading, or deposited with the purser, Carrier's liability with respect to passenger's baggage, effects and properties, on the account of loss, damage, delay or otherwise, shall be limited to and shall not exceed FIVE HUNDRED PESOS (Php 500.00). With respect to the effects and properties, other than baggage so defined, the same shall be at passenger's risk, and Carrier shall have no liability whatsoever for loss of life, or bodily injury, or any other loss, destruction, or delay in connection with this transportation unless a written notice of claim thereto is presented to Carrier within the period prescribed by law and unless suit or such claim is instituted within forty-five (45) days from the date passenger is landed or the vessel arrived at passenger's destination, whichever is earlier.

5. RIGHT TO REFUSE BOARDING. Carrier reserves the right to refuse boarding of a person or a passenger's cargo that may pose a threat to the security, order, safety, and health of other passengers and the vessel.
6. SICK PASSENGER. Carrier reserves the right to refuse boarding of a passenger suffering from any contagious disease. A demented person may be allowed passage, provided he is accompanied by a chaperon who shall be liable for his care, and must present a medical certificate attesting to his fitness to undertake sea travel. Any person found to be in violation of this ruling shall be disembarked at the first port of call.
7. VESSEL SCHEDULE. The sailing schedule of the vessel for which this ticket was issued is subject to change without prior notice.
8. LOST TICKET. In case this ticket is lost, the purser of the vessel concerned and the issuing office shall be notified immediately. No refund shall be made for the lost ticket unless after sixty (60) days from the date of issuance, verification was made whether the ticket has been used or not.
9. ROUND TRIP TICKET. The holder of a round trip ticket, when he takes the return trip, shall make a reservation with the head office or branch/agency of the Carrier within a reasonable time; otherwise, the Carrier is not bound to accommodate him on board.
10. UNUSED TICKET. A ticket issued one-way or round trip, if not used within thirty (60) days from the date of issuance, shall be automatically canceled and shall be not be honored for passage.
11. UNCOMPLETED VOYAGE. In case the vessel cannot continue or complete the trip for any cause whatsoever, the Carrier reserves the right to cancel the ticket and refund the passenger the value of his ticket.
12. VENUE OF ACTION. Any suit arising here from shall be exclusively instituted in a court of competent jurisdiction within the province of Masbate, effectively waiving all other venues.
13. REFUND AND REVALIDATION.
Any request for a refund, or revalidation shall be subject to surcharges, provided that the original, complete set of the
ticket is surrendered, and the passenger named herein presents a valid ID bearing his photograph. Refund and
revalidation of tickets shall only be accommodated during office hours
(8:00am to 5:00pm) from Monday to Saturday except for meritorious cases. Validation of refund ticket is up to 2 months (60 days).
